Terms and Conditions

Ele is a platform created by Independent Risk Distribution South Africa (Pty) Ltd, a licensed Financial Services Provider with FSP Number: 46861 and Registration Number: 2012/093979/07.

Please ensure that you read these Terms and Conditions prior to utilising Ele’s comparison tool. By utilising the comparison tool, you agree to be bound by these Terms and Conditions.

1. GENERAL

1.1. These Terms and Conditions apply to every person utilising Ele’s comparison tool to compare medical cover plans and premiums and shall be governed by the applicable laws of the Republic of South Africa.

1.2. By utilising Ele’s comparison tool, you specifically consent to the disclosure of your Personal Information as defined in the Protection of Personal Information Act 4 of 2013 which is further addressed in Ele’s Privacy Policy.

1.3. Ele may within its complete and sole discretion (with respect to the operation of the comparison tool and the services it offers) withdraw, suspend or discontinue any functionality or feature of the comparison tool and that it shall not be responsible for maintaining the functionality thereof for the benefit of any user.

1.4. Ele reserves the right to maintain, delete or destroy all communications and information posted or uploaded through the comparison tool pursuant to its internal record retention, archiving, and/or destruction policies.

1.5. Ele’s services include the provision of a free and unconditional quote. Should you have requested a quotation, you give Ele your consent to be contacted by representatives of medical cover providers.

1.6. By utilising the comparison tool, you further agree that Ele may contact you by telephone, registered mail or electronic mail to verify your Personal Contact Information and any other Personal Information it deems necessary in order for Ele to carry out its services.

1.7. If you have previously agreed to Ele processing your Personal Information and/or agreed to receive marketing-related material, your consent will remain in force until you have retracted your consent.

1.8. Ele provides you with medical cover plans/options comparisons and quotations free of charge.

2. INTELLECTUAL PROPERTY

2.1. Ele hereby grants the user use of the comparison tool solely for the purpose of viewing or downloading the comparison between medical cover plans/options (from various medical schemes) and or quotation material and the user shall obtain no right, license or any other intellectual property right relevant to the comparison tool.

2.2. Ele retains all rights, title and interest in, any patent, copyright, trade secret, trademark, service mark or other intellectual property or proprietary right in any of the foregoing, except for Information on www.ele.co.za (“Website”) belonging to the medical schemes reflecting the comparisons.

2.3. The information available on the Website is the property of Ele. By accepting these Terms and Conditions, you agree not to reproduce, retransmit, distribute, disseminate, sell, publish, broadcast, or circulate such any information to anyone.

3. CONSENT TO USE OF DATA

You hereby agree that Ele and the representatives and service providers authorised by Ele may use the information you provided via the website for comparison, quotation and marketing purposes.

4. CHANGES AND UPDATES

Ele may revise the information reflected on the Website, or otherwise change or update the scope of service we provide including updates to these Terms and Conditions, without notice to any individual user. Ele may also make improvements and/or changes in services and functionalities or add new features at any time without notice. We encourage you to periodically review these Terms and Conditions to see if there have been any updates or amendments to any information that may affect you.

5. LINKS TO THIRD-PARTY SERVICE PROVIDERS

Ele is not responsible for the content, security or privacy practice of any third-party service providers. Please review the privacy statement and any terms of use of each third-party service provider before the use thereof. Unless we specifically advise you otherwise, links to third-party service providers do not constitute or imply endorsement by us of those sites, the information they contain or any products or services they describe and Ele shall take no liability as a result of the utilisation by the user of such third party sites.

6. SECURITY AND CONFIDENTIALITY

Ele affords the same degree of confidentiality to the information provided to us through your utilisation of the Website as is given to information stored by us in any other medium. We are committed to protecting the confidentiality of your information. Ele will take all reasonable steps to secure all information it receives against unauthorised access, use, or disclosure from any unauthorised individuals.

7. PROHIBITED ACTIVITY

In consideration of being allowed to use Ele’s platform, you agree that the following acts shall constitute a material breach of these Terms and Conditions, and we shall have a right to unilaterally cease all communication to you and shall have the right to institute a claim if applicable:

7.1. signing on as or pretending to be another person;

7.2. transmitting material that infringes or violates the intellectual property rights of others or the privacy or publicity rights of others;

7.3. transmitting material that is unlawful, obscene, defamatory, predatory of minors, threatening, harassing, abusive, slanderous, or hateful to any person or entity as determined by Ele in its sole discretion;

7.4. distributing information of which ownership vests with Ele and/or its partners;

7.5. using interactive services in a way that is intended to harm, or a reasonable person would understand would likely result in harm, to the user or others; and

7.6. collecting information about others, including electronic mail addresses.

8. LIMITATION OF LIABILITY

Ele shall not be responsible or liable for any direct, indirect, incidental, consequential or any other loss or damages caused to you or any third party arising out, relating or incidental to your use of the Website.

9. DISCLAIMER

9.1. The user expressly acknowledges and agrees that the use of the Website and reliance on the operation, output or results of the service is at your sole risk and that the entire risk as to the satisfactory quality, performance, accuracy and effort is with you. Ele hereby disclaims all warranties and conditions with respect to the services offered through the Website. We take all reasonable steps to protect your Personal Information and maintain confidentiality, including the use of encryption technology. However, Ele can in no way guarantee the security or integrity of any information and you agree that you do this at your own risk.

It is important that you understand that the information provided through your use of the Website should not to be regarded as either advice or an intermediary service in terms of the Financial Advisory and Intermediary Services Act of 2002.
